1. Validity of General Terms and Conditions

Pelosi Labels GmbH makes all deliveries exclusively on the basis of these general terms and conditions. By placing an order, the customer automatically agrees to these General Terms and Conditions. These form an integral part of the contract between the customer and Pelosi Labels GmbH. They apply to the delivery of goods that the customer orders directly from sales, by e-mail, via the online shop or by telephone via the Pelosi Labels GmbH office service.

2. Information on the website / offers / prices

All information on www.pelosi-labels.ch is without guarantee or liability. Within the legally permissible framework, Pelosi Labels GmbH excludes any guarantee and liability for the correctness, completeness and topicality of the information on the website.

We reserve the right to change prices and assortment at any time. Images of all products and illustrations are not color-binding and may differ from the original. Technical designations and/or the content of the delivered products may deviate from the manufacturer's designations or the information provided on the Internet.

The current end consumer prices are published on the Internet at www.pelosi-labels.ch. Commercial purchase prices can be requested directly by email or by telephone.

The prices are binding for both parties at the time the order is placed. However, in the event of mistakes or errors in the price indication, Pelosi Labels GmbH reserves the right to subsequently make price changes. The customer is then informed and is not obliged to accept the products affected by the price change. All our prices are in Swiss francs and, unless otherwise noted or agreed, include the statutory value-added tax and exclude shipping costs.

In addition to the stated prices, the shipping costs expressly stated on the item page apply. From an order value of CHF 260 (including VAT), the shipping costs are covered by Pelosi Labels GmbH.

3. Terms of Delivery

Our packages are shipped by DHL Switzerland. Deliveries are only possible to delivery addresses in Switzerland. Delivery time is usually 2-4 days. All packages are only delivered by DHL against signature. Delivery against payment in advance is possible instead of cash on delivery. Deliveries are made exclusively within Switzerland. For pickup, you will receive an email as soon as your order is ready for pickup. Please pick up your delivery at the following address: Pelosi Labels GmbH, Haslistrasse 72, Mitte entrance, 2nd floor, 4600 Olten.

Deliveries are only sent within Switzerland. The shipping costs for all packages up to a purchase value of CHF 259 (incl. VAT) are CHF 9.90. From a purchase value of CHF 260 (incl. VAT) there are no shipping costs whatsoever.

We mainly supply private end consumers in the online shop. In principle, we supply commercial customers against telephone or written orders.

4. Order / Delivery

An order becomes binding for the customer after he has ordered goods verbally in person, by telephone, in writing using the order form or by e-mail. In the online shop by confirming his order at the end of the ordering process on the page on which the complete overview of the order is displayed by clicking the button Order with obligation to pay.

The customer then receives a delivery note with the shipment, which is issued after the order has been placed. For orders in the online shop, the customer receives a corresponding e-mail confirmation of receipt to the e-mail address provided by Pelosi Labels GmbH. Until the order is shipped, Pelosi Labels GmbH reserves the right to reject the order or to reduce the order quantity, which means that no contract is formed between the customer and Pelosi Labels GmbH, or a contract for the reduced order quantity. Unless the customer informs Pelosi Labels GmbH immediately that he is not interested in the reduced order quantity.

In particular, Pelosi Labels GmbH reserves the right to reject an order if there is a legal dispute with the customer, in particular in connection with payments not made from orders already placed with Pelosi Labels GmbH.

The complete and correct specification of the delivery address is the responsibility of the customer. If the customer provides an incorrect delivery address, delivery may not be possible. This means that Pelosi Labels GmbH can completely refrain from delivering the product without being able to assert any claims for compensation or damages. Pelosi Labels GmbH delivers goods exclusively to Switzerland.

When ordering, the customer confirms that he is at least 18 years old.

5. Delivery and Delivery Period

Pelosi Labels GmbH has a large stock of products. The customer should normally receive the products within 2-4 working days after ordering. Pelosi Labels GmbH does not ship on Friday. Orders placed on Friday will not be shipped until Monday. Ultimately, however, the delivery time depends on DHL and is beyond the control of Pelosi Labels GmbH.

For goods that cannot be delivered from stock, the time of delivery may be further delayed depending on the manufacturer.

Pelosi Labels GmbH can only be held liable for delays in delivery and their consequences if they were caused by a grossly negligent or intentional breach of contract by Pelosi Labels GmbH. Pelosi Labels GmbH assumes no liability for all other delivery delays and their consequences, including delays caused by DHL, suppliers of Pelosi Labels GmbH or other third parties.

6. Products delivered in error

Items delivered in error or too many items must be returned immediately in their original packaging; within 8 days at the latest. Any items not returned within this period will be invoiced.

7. Payment Arrangements

Invoices are due immediately without deductions. In principle, all orders must be paid in advance, cash on delivery, Twint or credit cards. Commercial customers can pay orders (1st order advance payment and from the 2nd order) with an invoice within 30 days. If due invoices are outstanding, Pelosi Labels GmbH reserves the right to make further deliveries only against advance payment or cash on delivery.

Orders via the website www.pelosi-labels.ch must always be paid in advance using the means of payment specified on the website www.pelosi-labels.ch. The following means of payment are available to you: Prepayment, Twint and credit cards (Visa, Mastercard, Paypal).

Orders with delivery against invoice is only possible for commercial customers after a credit check, from the 2nd order. The payment period in such a case is then 30 days per shipment. For all new customers, the first order is prepaid.

If the payment deadline is exceeded, Pelosi Labels is entitled to demand reminder fees of up to CHF 20 to partially cover the costs incurred. The open invoice amount plus any reminder fees and interest on arrears can be assigned or sold to third parties for collection purposes.

If prepaid, Pelosi Labels account details will be sent to you in the post-order confirmation email.

For payments at the post office counter, CHF 2.00 per payment must be added to each payment.

A credit check can be carried out at any time for both new and existing customers. The delivered products remain the property of Pelosi Labels GmbH in all cases until the ordered products have been paid for in full or payment has been confirmed by the credit card provider.

8. Dunning

If the payment deadline is exceeded, Pelosi Labels GmbH is entitled to charge reminder fees of up to CHF 20.00. The open invoice amount plus any reminder fees and interest on arrears can be assigned or sold to third parties for collection purposes.

9. Disclaimer of Warranty and Liability (Right of Withdrawal and Returns)

Pelosi Labels GmbH guarantees that the products are undamaged at the time of shipment. Products that were damaged during shipping will be repaired or replaced at the discretion of Pelosi Labels GmbH, provided that the customer reports the defect to Pelosi Labels GmbH by telephone or e-mail within 8 days of receipt of the goods using appropriate photos. If Pelosi Labels GmbH so wishes, the customer must also immediately return the delivered products to Pelosi Labels GmbH in the original packaging. Pelosi Labels GmbH will bear the shipping costs for this.

Furthermore, Pelosi Labels GmbH is liable to the customer for damages if and to the extent that such liability of Pelosi Labels GmbH results from the Product Liability Act.

Any further warranty for the delivered products and any liability for damage caused by these products is excluded, unless Pelosi Labels GmbH had fraudulently concealed the product defects in question. However, if Pelosi Labels GmbH can assert further warranty claims against its suppliers for the product in question, Pelosi Labels GmbH will, if possible, assign these claims to the customer at his request. However, Pelosi Labels GmbH assumes no responsibility for this 

that these claims can be successfully enforced. The same applies to any claims that Pelosi Labels GmbH has against DHL for damage that occurred during transport.

In particular, Pelosi Labels GmbH does not guarantee that the products are suitable for the customer's intended use or that they will produce a specific result. The warranty also excludes damage for which the buyer is responsible, e.g. as a result of improper treatment, use, handling or damage caused by external influences for which the seller is not responsible, such as damage caused during transport.

The right of return does not apply to goods that have already been opened, used or damaged by the customer, special orders or goods that have been specially manufactured at the customer's request. Returned products or packages will only be accepted if they are in proper condition, i.e. unused, unopened, undamaged and in their original packaging. The customer must bear the costs of the insured return.

Customers have the right to return the goods during 8 days after delivery of the goods. The right of return is exercised by returning the goods and giving a reason for the return. In addition, write a short e-mail to info@pelosi-labels.ch beforehand so that we are informed about the return in advance and can monitor it accordingly. The return must be sent to:

Exercising the right of return leads to the conversion of the purchase contract into a rescission relationship, after which the services received under the purchase contract must be reimbursed. The customer bears the costs for the insured return.

After receipt of the goods, any purchase price that has already been paid will be refunded to the customer immediately.

Dirty and damaged returns due to careless and defective packaging of the return cannot be taken back. The responsibility of a safe return rests with the customer.

We reserve the right to deduct the purchase price to be refunded or an invoice for possible damage or improper wear and tear of the goods. No deduction is made if the loss in value is due to the handling necessary to determine the type, quality and functionality of the goods. Pelosi Labels GmbH can refuse repayment until it has received the goods back or until the customer has provided proof that he has sent the goods back, whichever is earlier.

10. Retention of Title

Delivered goods remain the property of Pelosi Labels GmbH until the purchase price has been paid in full and all claims resulting from the business relationship have been settled in full. The goods may only be resold by the customer within the framework of his normal business operations. Pledging or security transfer is not permitted. The customer assigns his claim from the resale to us. This also applies to the corresponding claim amount for claims from a current account. The assignment is hereby adopted. The customer is entitled to collect the claim.

11. Guarantee

If no other warranty period is specified, you will receive a 1-year warranty for professional use and a 2-year warranty for private use on the goods purchased from us that are entitled to a warranty (electrical devices). You can assert this by enclosing the invoice.

12. Privacy

The customer's personal data is used exclusively to process the customer's orders and - in compliance with data protection regulations - to provide the customer with advertising information. Customer information can be provided by post, telephone or e-mail. The customer can object to the sending of customer information at any time without incurring any costs.

13. Liability

Liability for product defects or damage caused by such defects is based exclusively on Item 9. For damage resulting from late delivery, Item 5 applies exclusively.

In addition, Pelosi Labels GmbH excludes any other liability to the customer in connection with the products, the use or the (non-)availability of the website www.pelosi-labels.ch within the scope of the legally permissible. For example, claims for damages due to impossibility of performance, non-performance and tort are excluded both against Pelosi Labels GmbH and against their vicarious agents, unless intentional or grossly negligent action is involved.

14. Partial invalidity / validity-preserving reduction

If a provision of these terms and conditions should be invalid in whole or in part, this has no influence on the validity of the remaining provisions and their purpose comes closest, without self 

to be invalid. The customer's general terms and conditions do not apply, even if we do not expressly object to them.

15. Refusal to Accept Goods

If the customer refuses to accept the goods upon delivery for an unjustified reason, Pelosi Labels GmbH is entitled to invoice the resulting shipping or freight costs.

16. Governing Law / Jurisdiction

The contract is exclusively subject to Swiss law. The place of jurisdiction for all disputes with Pelosi Labels GmbH is Olten (Switzerland), subject to deviating mandatory places of jurisdiction under federal law. However, Pelosi Labels GmbH is also entitled to sue at the place of residence of the customer or at another legal place of jurisdiction.

17. Oral agreements

Verbal agreements are only effective if they have been confirmed by us in writing.

18. Changes to Terms and Conditions

Pelosi Labels GmbH expressly reserves the right to adapt the present General Terms and Conditions (GTC) to the circumstances at any time and to apply them immediately to subsequent orders.
